The FTC imposed rules on companies that offer services using free credit reports as an incentive to attract customers. The new regulations require that free credit report offers clearly differentiate themselves from the AnnualCreditReport.com Web site, through which individuals are entitled to free credit report information annually. The regulations also restrict advertising and paid offers on AnnualCreditReport.com.
Arnold, a nationally recognized consumer educator and advocate, says the new laws are a boon to consumers. “I think this is a positive step for consumers. As the editor of CardRatings.com, I have always strived to promote awareness of one’s own credit reports and credit scores. It’s unfortunate that some companies have taken advantage of people’s desire to manage their credit reports as a way to sneak in unwanted services. The end result has been major confusion among consumers.”
Since 2003, Americans have had the right to a free annual credit report at AnnualCreditReport.com with no strings attached. Other sites have since proliferated, claiming to offer credit reports for free. In actuality, these sites–which frequently ask for consumers’ private information and credit card numbers–often tack on trial offers for credit monitoring services or even unrelated items such as magazine subscriptions that are billed later. These extras are not always prominently disclosed, and consumers are further misled by advertising that reinforces the claim that these credit reports are free.
Offering something for free in order to get you to try and perhaps buy a service is a legitimate marketing technique, and reputable firms make cancellation and/or refunds easy to get. Yet many who sign up for free credit report offers–only to be billed for services they did not want–report poor experiences or even scams.
Because the operative word here is “free,” those who charge for credit reports are not subject to the new regulations. Arnold explains how some companies are taking advantage of this: “Be mindful that some companies, including respected credit bureaus, have already developed clever ways to avoid the FTC’s regulations. For example, the popular site FreeCreditReport.com that is owned by Experian (the one with the catchy little TV commercial jingles and three hapless guys) is now charging customers $ 1 and then donating the $ 1 to charity.

The three major credit bureaus participating in the AnnualCreditReport.com Web site delay advertising or paid upgrade offers until after a consumer has completed his or her request for credit reports; and
Television and radio advertising for free credit reporting services as of September 1 include disclosures about related trial offers and refer potential consumers to the AnnualCreditReport.com Web site and toll-free number.

All U.S. residents were granted access on September 1st, 2005 to their credit reports as allowed by federal law. It happened amongst a mist of lawsuits, misinformation, and misdirection even from the credit reporting agencies themselves: Equifax, Experian, and Transunion.
Don’t try to get yours directly from the credit bureaus. The websites Experian operates, Consumerinfo.com and freecreditreport.com, settled with the FTC in August for â$ 950,000 in ill-gotten gainsâ according to David H. Press of Integrity Bankcard Consultants Inc.”
âThe federal government estimates nine million people signed up for free credit reports and ended up being billed $ 80 for a full year of credit monitoringâ said KVUE News in a Consumer Alert they issued last month warning consumers of the âFree Credit Reportâ offers.
Despite the FTC’s efforts to protect consumers the misleading practices continue. Freecreditreport.com and consumerinfo.com offer the âfree credit reportsâ as a trial offer for their credit monitoring service. Disclosures are there – in fine print dwarfed by the statements – âFreeCreditReport.com,â âFree,â âFast,â âEasy,â & âGet Yours Now.â
The credit reporting bureaus are taking some measures to comply. Experian added a link to the top of their website to the only site where the free credit reports are available – yes, really, totally free, with no credit card required: annualcreditreport.com. And Equifax’s Corporate Vice President & General Counsel, Kent E. Mast sent an e-mail to all of Equifax’s online affiliate’s asking them to, âPlease review promptly your websites and URLs and take all measures to ensure that they do not mislead or divert consumers from annualcreditreport.comâ
On September 1st, residents of every state in the union, the U.S. territories and possessions, and Puerto Rico were granted access to their credit reports for free every 12 months — a right the FTC fought years for.
Consumers worried about identity theft, concerned about loan rejection, or simply curious about their credit standing can go online to http://www.annualcreditreport.com. Within 15 minutes they will be able to view or download their credit report, the document that defines their credit-worthiness, without being asked for a credit card – and without the credit monitoring baggage.

Now that the summer fun is over, it’s back to reality. With the kids back in school, this can be a great time to do an assessment of one’s personal finances and make a plan for future spending. Consolidated Credit Counseling Services Inc. is urging consumers to evaluate their expenses to make sure their personal finances are in order for the rest of the year.
In the first half of 2011, the average national mortgage debt per borrower increased to $ 190,115, according to TransUnion. The average credit card debt per borrower was $ 4,679.
“With debt in the United States continuously growing, it is extremely vital to seize control of your current finances,” says Howard Dvorkin, CPA and founder of Consolidated Credit. “The best way to end the year is to achieve financial prosperity through knowledge of your assets, money management and proper savings.”
Dvorkin, who has had almost 20 years of financial experience, is offering a Fall Financial Check-Up to help consumers remain on top of their money situation before the Christmas crush is upon them. Steps consumers should follow to do a financial check-up:
1. Get a free credit report. The Fair Credit Reporting Act (FCRA) requires each of the nationwide consumer reporting companies — Equifax, Experian, and TransUnion — to provide a free credit report, at your request, once every 12 months. Visit annualcreditreport.com to request it immediately. Knowing one’s credit score is a a valuable asset for any future large purchases or employment opportunities.
2. Pay off debts. Don’t put off debt any longer. If debt is becoming a burden, enroll in a debt counseling agency to get help. Certified financial counselors can offer advice that can lower payments by consolidating debt, enabling a person to become debt-free faster and easier.
3. Manage finances. Create a budget to know how much you’re able to spend each month. Do not use credit cards; it’s much better to pay for items in cash to avoid credit card troubles. Also, start a savings account in case any emergency expenses turn up.
4. Do taxes early. Gather documents and receipts now. It’s better to start on taxes early to allow time for changes. Do research on allowable deductions. For example, medical expenses that exceed 7.5 percent of income can be deducted.
5. Identify goals. People are more encouraged to save money if they have a goal in mind. A trip to Hawaii or a cruise in the Bahamas can serve as an incentive to putting away savings. Buying a newer car in full can also be a great aspiration as there is no need for financing or any associated interest.
6. Protect assets. Look over insurance plans and see if any policies have changed. Review homeowner’s or renter’s insurance to make sure the home is well-protected. Don’t forget about auto insurance and health insurance. Also, do a quick check-up on the warranties associated with expensive electronics to determine whether purchasing a newer model is better than extending the warranty.
7. Review retirement plans. One of the best tax-reducing strategies is to contribute the maximum to a 401(k) plan. The Internal Revenue Service (IRS) has announced that the 2011 maximum pre-tax contribution to the 401(k) is $ 16,500. If one’s employer doesn’t have a 401(k), they may want to set up an Individual Retirement Account (IRA) on their own to ensure funds for retirement.

Yes, you have a right to receive an absolutely free credit report from each of the three credit reporting agencies in the United States. Your right to receive an absolutely free credit report is a federal public law, precisely, public law 108-159. The law that made an absolutely free credit report for consumers a right was passed by The 108th Congress on December 5, 2005. It is entitled the Fair and Accurate Credit Transaction Act (FACT) of 2005.
The Act amended an earlier credit report law entitled the Fair Credit Reporting Act. FACT amended the Fair Credit Reporting Act to include a provision for an absolutely free credit report. In Title II of FACT, (IMPROVEMENTS IN USE OF AND CONSUMER ACCESS TO CREDIT INFORMATION), under section 211, which is entitled “Free Consumer Reports”, all credit reporting agencies are required to give consumers their credit reports once during a 12 month period “upon the request of the consumer without charge to the consumer”. This law reversed the practice of credit reporting agencies to charge consumers for their own credit report.
FACT goes on in Title II to state that the consumer may get an absolutely free credit report only if the consumer makes that request from a centralized source that a government commission would oversee in its development. At minimum, credit reporting agencies are required to provide a toll free number consumers may call to make their request. It also states that credit reporting agencies have 15 days in which to provide the absolutely free credit report to the consumer after the consumer has made the request.
FACT also states that consumers may also request a reinvestigation of the details of their credit report after they receive it and that credit reporting agencies must complete that investigation within 45 days after a request for reinvestigation. This assures that consumers may use the absolutely free credit report after they receive the results of the reinvestigation.
The three credit reporting agencies in the U.S., Equifacts, Experian, and Transunion, together formed a centralized source that consumers can use to request their credit report as required by FACT. You can call their toll free number, which is 877-322-8228, to make your request. Alternatively, you can mail your request to the Annual Credit Report Request Service, P.O. Box 105281, Atlanta, GA 30348-5281. You can also apply for it online and receive it online at the Annual Request Service’s website at www.annualcreditreport.com. Once you have your report, what do you look for?
Here are some basic things you should check on your report. Go through your entire report entry by entry. Have the credit agency legend by your side in order to verify coding compliance. Have also a paper and pencil to annotate any item you find in error. Go slowly.
Don’t assume your personal information is correct. You could be viewing information from someone else’s report with just a simple error such as: first name misspelled, missing Jr./Sr., erroneous address, bad zip code, wrong employer, or any other incorrect personal data.
Insure marital information is correct. Are accounts listed as “joint” really joint?
Is the report in compliance with court settlements? Outdated information is normally considered to be any item older than 7 years except for bankruptcy, which is usually 10 years.
Closed accounts should not be listed as open. Accounts you closed should reflect, “Closed by consumer”. Otherwise it can be assumed that it was closed by the creditor– not good.
Accounts should not appear twice even in different sections.
Incorrect histories such as late payments, a credit entry you do not recognize, a pre-marital debt of your current spouse, or other such items need your attention.
Are there missing reports that would be beneficial to show a good history, and are profiles, credit limits, and balances correct?
A former correction to your credit file that has since disappeared should be brought to the agency’s attention.

Final Comments: I am often asked if a collection company sells your account to another collection agency, can you get the first one deleted from your report or will it just show as a zero balance
Reporting depends on who owns the account there are several directions this can take:
If the original creditor still owns the account but assigns the debt to a collection company then both get to report on that account listing.
If the original creditor retracts the collection and re-assigns it to a new collection agency then both original creditor and the 2nd collection agency can report but the first one must remove their listing off of the credit report.
If the original creditor sells the debt to a collection agency then the creditor will report zero balance / sold to another lender, and the collection agency will report.
If that collection agency assigns a debt to another collection agency then it is allowable for both to report the account listing, but if they take back that account then that assigned collection agency must remove their reporting.
Now if that collection agency sells the debt to another collection agency they get to keep their reporting on the report since they owned the account at one time, and the new collection agency picks up on the reporting.
Therefore, the difference is if your account is “assigned” or “sold”.
